2. About these general terms and conditions

2.1 These conditions apply to all orders. Every order implies the explicit acceptance of these sales conditions.

2.2 The minimum age to place orders with us is 18 years. If you have not reached the age of 18 yet, we kindly request you to ask your parents or legal guardian to place the order. If we notice an order is being placed by a minor, we retain the right to refuse this order.

3. Placing your order

3.1 You may place an order by filling in the order form on the website LaLotti and clicking on the appropriate submission button.

3.2 When you place your order, you will receive a web order number.

3.3 By placing an order, you make an offer to us to purchase the products you have selected on these terms and conditions. We may not accept your offer at our discretion.

3.4 In case we accept your order, we will notify you by sending you an order confirmation by email. This confirmation is binding the moment we send it to you. If we cannot accept your order, we will try to contact you by phone or email.

3.5 BVBA OFF SIDE CONSULTING shall not be held liable for any losses incurred as a result of the unavailability of an item.

3.6 In case of late payment by the customer or problems with previous orders BVBA OFF SIDE CONSULTING has the right to dissolve the contract.

4. Price

4.1 Our prices include are mentioned in euro, VAT included and shipping costs excluded (and if applicable, handling costs excluded) unless mentioned otherwise.

4.2 The prices are valid on the moment of publication, where after they are subject to changes.

5. Payment

5.1 Payment can be made in any of the manners specified on the website.

5.2 BVBA OFF SIDE CONSULTING stays the owner of the goods until you have paid them completely.

6. Right of withdrawal

6.1 In accordance with the law of 30 December 2013 regarding book VI of the Code of Economic Law “market practices and consumer protection”, the consumer has the right to inform BVBA OFF SIDE CONSULTING in writing within 14 calendar days of receipt of the product that he or she wishes to renounce his / her purchase. We explicitly ask you to complete and send the enclosed return form.

6.2 We advise the consumer to return the returned product in its original packaging, in perfect condition. If an item is damaged sent back, El Sorelle can claim compensation from the consumer that is proportional to the depreciation that the item has undergone. (Article VI.51, §2 WER) Any return of which the sender cannot be identified will be refused.

6.3 The handlingcosts for the return of an item  is 25€  and are for the account and under the responsibility of the consumer.

7. Delivery

7.1 We will deliver the products which are indicated on your order confirmation. BVBA OFF SIDE CONSULTING can, in no way, be held responsible for errors made by the customer concerning the delivery or billing address and for eventual late deliveries or the impossibility to deliver the products ordered, due to that mistake.

7.2 Title to and risk of loss concerning your products, will pass to you on delivery of the products to the address stated in your order confirmation.

7.3 When a product is in stock, it shall be delivered to your delivery address within 3 to 5 workdays in Belgium. This delivery schedule is an indication and therefore not binding.

7.4 Deliveries are scheduled during office hours from Monday until Friday (except on holidays).

7.5 If a product is not in stock, the consumer will be notified with an email about an other delivery date. In case the consumer doesn’t agree with the delay, the order can be cancelled or the consumer can order an alternative product. The price for the cancelled order will be refunded or, in case of an order for an alternative product, a new invoice will be made or credited, considering the price paid for the product that is cancelled.

7.6 If we are not able to deliver within the agreed time, you will be notified before the delivery term expires. If we fail to deliver within the agreed time, you can decide to cancel your order and you will be refunded within 30 days after cancellation.

7.7 We cannot be held responsible for consequential damage due to late delivery or non-delivery by the courier service that we use.

8. Guarantee

8.1 Without doing any harm to the right of renunciation, the consumer can apply to all the legal guarantees that comes with the products on our website.

8.2 We guarantee that our products will match your order and will satisfy your normal expectations given the specifications of the product.

8.3 BVBA OFF SIDE CONSULTING is not liable for technical data given by the producer or delivery company.

8.4 We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

9. Force majeure

9.1 In case of “force majeure”, we are not obliged to fulfill our obligations. In that case we can suspend our obligations while the force majeure lasts or we can definitively dissolve the arrangement.

9.2 Force majeure is every circumstance beyond our control that prevents the fulfillment of our obligations, either partially or entirely. Force majeure can be seen as: strikes, fire, business interruption, energy interruption, interruptions in (telecommunication-) network or connection or used communication systems and/or the malfunction of our website, late or non-delivery of the suppliers or other engaged third parties.

10. Intellectual property

10.1 Our website, logo’s, text, photos, names and in general every communication is protected by intellectual property rights that are with our suppliers or other stakeholders.

10.2 It is forbidden to make use of and/or change the intellectual property rights as subscribed in this article. For instance drawings, photos, names, texts, logos, colorcombinations, etcetera … cannot be copied nor reproduced without prior and explicit written permission.

11. Settlement of complaints

We will do everything in our power to treat your complaint within 7 workdays.

12. Disagreements governing law and jurisdiction

12.1 We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, then you have to do it in Belgium.

12.2 The Belgian law applies to the contract.

12.3 The Online Dispute Resolution Platform, in short ODR, is a disputes committee for online purchases and sales within the EU. The ODR has been active since 9 January 2016 and acts as an information center on consumer rights and on out-of-court dispute resolution.

SHIPPING & DELIVERY

All orders will be shipped from our warehouse in Belgium.
Orders fit through the mailbox.

1. WHEN DO WE DELIVER?

BVBA OFF SIDE CONSULTING aims to process and ship all orders within 1 – 5 days, office days if the item is available.

DPD delivers from Monday to Friday.

2. SHIPPING COSTS

BVBA OFF SIDE CONSULTING ships every order.

For shipments below 100 euro we charge 10 euro.

3. DO YOU DELIVER TO MY COUNTRY?

The complete list can be checked during checkout. If your country or region is not in the list, unfortunately we are not able to deliver to your country or region yet. We will continue to work hard on adding countries in the future.

Please note that some regions or states are excluded for delivery. If you really want to know if it is possible to deliver to your region or province, please check it during checkout. You can also contact us.

2. WHICH SHIPPING METHODS CAN I CHOOSE?

At the moment, we only offer standard shipping via local logistics partners. Sometimes, those logistic partners work together with other local distributors to make sure your order can get delivered on time, so it might occur that you receive your order from another courier service.

3. HOW LONG DOES IT TAKE FOR MY ORDER TO BE DELIVERED?

When your order is ready to be shipped, you will receive a shipping confirmation by email. Please allow some time for the status of the shipment to correctly display at the above address.

Belgium: 3 to 5 workdays

4. DO I HAVE TO PAY CUSTOMS AND/OR IMPORT CHARGES?

Depending on the country or region you live in, it is possible that extra Import Taxes, VAT, Custom Fees or possible toll fees can be charged upon arrival of your order.

5. IS THERE A WAY TO TRACK MY ORDER?

No, because the low shipping cost. If you want tracking please contact us before placing your order.

6. CAN I CHANGE MY DELIVERY ADDRESS?

Unfortunately, it is not possible to change your delivery address after your order has been shipped. So if you haven’t received a shipping confirmation, we can often still change your delivery address.

When you just passed your order and you realize that you made a mistake, please contact us via our contact sheet and provide us with the following information:

•Your name

•Your order number

•The new complete (!) delivery address

We will do our utmost to pass the information to our logistics partner on time in order to change the delivery address.

Before placing an order, you can of course change your delivery address during checkout.

7. I DIDN’T RECEIVE MY ORDER, WHAT CAN I DO?

Please keep in mind that your order may be delayed due to safety measures of the customs authorities and that we have no influence on delivery delays.

If you have received a shipping confirmation and you feel like your order is not delivered within the specified delivery time, please contact us via our contact sheet and we will start an investigation with our logistics partner. This may take several days and a refund or replacement shipment can only be executed after this investigation, or after 30 days. Please allow some time for the status of the shipment to correctly display at the above address.

8. RETURNS
Our policy lasts 14 days. If 14 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. We always calculate extra administrations cost of 25€ for a return.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Sale items (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over 100 euro, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
